TERMS OF USE

If you do not agree with all of these terms, please do not use the Service. By using the Service, you acknowledge that you are at least 13 years old and you unconditionally agree to comply with and be bound by these Terms, including the Privacy Policy.

Tale reserves the right to modify these terms at any time and at its sole discretion. By continuing to use the Service after such changes, you agree to comply with and be bound by the modified Terms of Use.

No Access to Emergency Services: There are significant differences between Tale and your mobile phone and SMS services.

Our Services do not provide access to emergency services, including police, fire departments, hospitals, or any other connection to emergency call centers.
You must ensure that you can contact the appropriate emergency services through a mobile phone, landline, or other service.

Article 1 – Legal Notice

The "Tale" application is operated by BLYPE SAS with a share capital of €1,000, registered with the Toulouse Trade and Companies Register under number 883 172 108, with its registered office located at 1 rue Voltaire, 31830 Plaisance du Touch, France.

Publisher of the Tale Application Services: Mr.Yannis Bayadroun, President.

Hosting provider of the Services: SCALEWAY SAS, with a share capital of €214,410.50, whose registered office is located at 8 rue de la Ville de l’Évêque, 75008 Paris, France.

Article 2 – General Provisions Regarding These Terms and Conditions

The Terms and Conditions of Use (the "Terms and Conditions of Use" or "T&Cs") apply exclusively to the services offered by BLYPE on Tale.

These T&Cs aim to define the conditions under which Users can access and use the Services.

The T&Cs are made available to users on the Website, where they can be directly viewed, and may also be provided upon simple request by any means.
Any person who accesses and/or uses one of the Services offered by Tale agrees to comply, without reservation, with these Terms and Conditions of Use.

The User is expressly informed that the only legally binding version of Tale’s online services T&Cs is the one available through the “Settings” feature via the “Terms & Conditions” link at the time they access and/or use the Services, which they acknowledge and accept without restriction, agreeing to refer to it each time they connect.

These T&Cs are permanently available, except in cases of force majeure.
The T&Cs are binding on the user, who acknowledges, by checking a box provided for this purpose, having read and accepted them prior to using our services.

Article 3 – Definitions

Application :
Refers to the TALE application, which can be installed on a mobile phone, tablet, or any other existing or future mobile device, and allows Fans to be rewarded for their loyalty to their favorite creators featured on the mobile application, in accordance with these Terms of Use. The TALE Application is subject to these T&Cs.

BLYPE :
Refers to the company providing the Services through TALE.

T&Cs :
Refers to these Terms and Conditions of Use for the Services of the Tale Application.

Content :
Refers to information, data, text, photos, images, messages, audio, or any other elements that may be shared by a User, under their own initiative and responsibility.

Personal Data :
Refers to personal data relating to a User and subject to declarations with the French Data Protection Authority (CNIL). Under no circumstances shall Tale be considered the owner of Users’ personal data.

Follower/Following :
Refers to when a User chooses to follow another User.

Username :
Refers to the identifier chosen by the User to represent themselves on the TALE Application when interacting with other Users. The Username can be modified freely without requiring a new User Account. Usernames are unique and cannot be used by multiple Users simultaneously.

Profile Picture :
The profile picture is chosen by the User from their device gallery or taken directly with their camera. It represents them on the Application to other Users. The profile picture can be changed at any time without affecting the User Account.

Fan(s):
Refers to a type of User who creates an account. These users can accumulate Points in order to be rewarded.

Creator(s):
Refers to a type of User. These users can create Rewards to offer to Fans in exchange for Points.

Platform(s):
Refers to third-party services including social media, video streaming platforms, and audio streaming platforms. User accounts on these Platforms may be Linked to Tale if the User chooses to do so.

To Link (a Platform):
Refers to the process by which a User shares their Platform account identity with Tale through: their username; or a secure login to the Platform.

Action(s):
Refers to any activity through which a User can earn Point(s). Actions can be internal to Tale — such as scanning a Creator's Tale QR code, clicking a Creator's Tale Link — or external to Tale — such as liking, sharing, watching, listening to, or commenting on a Creator’s post on a Platform, provided the Creator has linked their account on that Platform to Tale, and the User has done the same.

Point(s):
Refers to a virtual currency unit specific to Tale. Fans earn Points through Actions and use them to redeem Rewards from Creators on Tale. A user has a separate Point balance for each Creator. Points earned from Actions related to a Creator only apply to that specific Creator.

Reward(s):
Refers to an item created by a Creator that can be redeemed by Fans using their earned Points. Rewards may vary in type (audio, video, image, discount code, collectible reward, meet-and-greets, etc.), may or may not have an expiration date, and may or may not have limited availability.

Collectible Reward(s):
Refers to a type of Reward that must be collected by the Fan who redeemed it using Points, directly from the Creator or a third party. The Fan receives a QR Code that can be validated to confirm the purchase and deliver the item.

Profile:
Refers to the page associating a Profile Picture, a description, Rewards, and Actions to a Username. This is the identity under which the User will be known to future Followers.

Service(s) :
Refers to one or all of the services provided by BLYPE and accessible through the Tale Application, distinct from the Content.

Hardware Device :
Refers to any existing or future technical tool (mobile phone, tablet, etc.) allowing the downloading, storage, and access to the Tale Application Services.

User :
Refers to any individual aged 13 or older, or any legal entity accessing the Service(s) by installing the TALE Application and accepting the T&Cs.

User Account :
Refers to the right of access to the Application Services granted by Tale. The User Account can be created via the Application and links all of the User’s Content and Personal Data. Upon deletion of the Account, all associated data — including Content and Personal Data — is permanently erased.

Article 4 – Creating a User Account & Accessing Online Services

To start using Tale, a prospective User must create a User Account. A User Account can be created after downloading the Application. The account is linked to the identifier of the hardware device used.

Creating a Username is only mandatory once the User chooses to set up their User Account. After downloading the Application, the User will be able to access their User Account interface and the Application’s Services, once they accept the present Terms of Use.

The equipment (such as computer, phone, tablet, software, electronic communication tools) required to access and use one or more Services is the sole responsibility of the User, as are any electronic communication costs (including telephone or internet access charges) resulting from their use. It is the User’s responsibility to check the cost of using such equipment and/or services with the relevant providers. The User is solely responsible for these costs.

Article 5 – Operational Terms

The use of the User’s device and the Application is entirely at the User’s own initiative and under their sole responsibility.The User is solely responsible for how their device and their User Account are used.

Any access to or use of the Services and any data transmission made from a User’s Application will be deemed to have been made by that User.The confidentiality of the User Account provided to the User is their sole responsibility.

Any loss, misuse, or unauthorized use of the User Account or the device and any resulting consequences are the sole responsibility of the User.

A User Account has no time limit and may be deleted by the User at any time. The Services are provided by Tale for an indefinite period.

The User expressly acknowledges that Tale may rename the Service and/or the Application, terminate the Services, and consequently delete their User Account, Contents, and all data stored by the Services without prior notice, compensation, or justification.

Additionally, in the event of a breach of these Terms of Use or, more generally, in case of violation of applicable laws or regulations, Tale may terminate, without prior notice or compensation, all or part of the Services provided to the User. Tale may delete the User Account as a result of such termination, without prejudice to any damages or penalties it may claim due to these breaches.

The User acknowledges that Tale has the right to delete their User Account.In case of a breach of these Terms, Tale may also suspend the Service, either temporarily or permanently, and may block the User from using certain features of the Application.

Article 6 – The Services

Tale is an online social networking service that allows Fans, through an internet connection, to earn Points used to access Rewards available within the communities of Creators.

Use of the Service is done through the User’s device, primarily a mobile phone or tablet.

The User agrees not to respond to or engage with any Content that violates applicable laws and/or to report such Content.

Tale does not guarantee the truthfulness, integrity, or reliability of the exchanged Content and cannot be held liable for false statements made by a User or for incorrect data and information provided by Users. Tale disclaims any responsibility for meetings that may result from the use of the provided Services.

As part of using the Services, the User agrees not to disclose information that allows the precise and nominative identification of other Users or any natural or legal person, including but not limited to: last name, company name, email address, phone number, physical address.

Users are also advised not to disclose their own personal identifying information to third parties via the Services.

Users are explicitly informed that all Content is created or shared under their sole responsibility. Only the owner of the device linked to the User Account shall bear full civil and criminal liability for the Content associated with and displayed on their User Account.

The User agrees that all Content they share does not contain elements that violate laws or regulations in the country from which they access the Service, or in the countries where such Content is received, nor that may harm third parties or violate the rules outlined in the following article.

The User declares to be the owner of all Content associated with and displayed via the Services, and that they have full rights and permissions to host such Content. Otherwise, the User is deemed to have obtained proper authorization from the rightful owner of the Content associated with their User Account.

The User must not upload or share any Content that infringes on others' intellectual property or personal rights, including but not limited to: copyrighted works, trademarks, likenesses of individuals or properties, trade secrets, internal or confidential information.

According to Article 323-1 of the French Penal Code (Ordinance No. 2000-916 of September 19, 2000, Official Journal of September 22, 2000, effective January 1, 2002), which states, among other things, that “fraudulently accessing or remaining in all or part of an automated data processing system is punishable by two years' imprisonment and a €30,000 fine,” the User agrees not to attempt to access the Tale application using another phone, tablet, or technical means after having been temporarily or permanently banned from the Service.

After downloading the Tale application, the User chooses a Username. This Username may be freely changed by the User without affecting the User Account. The Username is unique.

The User Account is linked to the identifier of the device used to access the Tale application.

The User can delete their User Account at any time by going to the “Settings” feature in the Application. Their data will then be erased within one (1) year, in accordance with applicable legal provisions. The User can also request deletion directly by email : contact@tale.fan

Deleting a User Account will result in the immediate deletion of all Content created by the User and removal of the Username.

Article 7 – User Request Service

The User may send requests by email to contact@tale.fan including their full name, username, phone number, and the purpose of their request.
Any complaint and/or dispute from the User against Tale must be submitted in writing and sent to Tale no later than fifteen (15) days from the date of the event giving rise to the claim, otherwise it will be considered time-barred.

Article 8 — Liability and Personal Data

Tale cannot be held responsible for the way Users use the Services. In particular, Tale can under no circumstances be held liable for any Content displayed, exchanged, received or transmitted by Users, in accordance with its status as a hosting provider as defined by French Law No. 2004-575 for confidence in the digital economy, dated June 21, 2004.

The User acknowledges and accepts that Tale is in no way liable for the creation, modification, deletion, or failure to receive, send, transmit or store data by Users, which remains their sole and exclusive responsibility.

The User also acknowledges that Tale reserves the right to change the name of its online Services at any time, without this constituting a modification of the Terms and without giving rise to any form of claim by the User.

Tale provides no express or implied warranty, including but not limited to continuity, performance, durability, suitability, compatibility, or quality of the Services, nor the absence of defects, legal violations, or infringements of these Terms or applicable laws by other Users.

Any data downloaded or otherwise obtained during use of the Service is done at the User’s own risk. The User is solely responsible for any damage to their device or loss of data resulting from the download or consultation/use of the Services.

No advice or information, whether oral or written, obtained by the User from Tale shall create any warranty not expressly stated in these Terms.

The User acknowledges that they use the Service at their own risk. The Service is provided "as is" and is accessible without any guarantee of availability or reliability. Tale will endeavor to keep the Services available 24/7, except in cases of force majeure or events beyond its control, including maintenance, outages, technical issues related to mobile and/or internet networks, malicious acts, or damage to Tale’s hardware or software.

Tale cannot be held liable for any interruption of Service, regardless of the cause, duration, or frequency.

Transfer speeds and response times of data exchanged via the User’s device are not guaranteed by Tale. These depend on the device, mobile or internet networks, and the User’s internet access provider.

Tale cannot be held responsible for how mobile phone manufacturers collect and store geolocation data on which the Application runs, especially in terms of privacy or personal data — such matters are handled directly by the phone manufacturers.


Privacy and Personal Data Protection

This article applies only to Tale’s Services and not to third-party websites, for which Users are encouraged to review their respective terms and policies regarding the collection and processing of personal data.

Collection, Processing, and Storage of Personal Data

Tale respects fundamental freedoms, especially the right to privacy. Personal data processing during use of the Services is governed by all necessary formalities declared to the French CNIL (Commission Nationale de l’Informatique et des Libertés).

By accepting these Terms, the User agrees to the collection, processing, and storage of personal data resulting from usage, though Tale never becomes the owner of this data.

Right to Access, Modify, or Delete Personal Data
In accordance with French Law No. 78-17 of January 6, 1978 (as amended), each User has the right to oppose, access, and rectify their data. They may request that inaccurate, incomplete, or outdated information be corrected or deleted.

Account Closure & Data Retention

When a User account is closed for any reason, related data is deleted. However, deletion may be delayed up to one year in order to ensure security, detect and prosecute criminal offenses, and support law enforcement access if necessary.If the User deletes the Tale app without also deleting their Account, their data will remain stored until an explicit deletion request is made by the User.

Content Responsibility and User Conduct

Users agree to use only Content for which they hold rights, or have obtained consent from the rights holder, or that is royalty-free.

The User shall hold Tale harmless from any third-party claims arising from a violation of their rights or from misconduct by another User. The User agrees that any individual featured in their shared content has given prior consent for the use of their image.

Users must comply with all applicable laws, including the prohibition of content that is pornographic, obscene, pedophilic, or that gravely violates human dignity. Content must not promote propaganda, proselytism, or be used for commercial/professional purposes (solicitation, prostitution).

Harassment is strictly forbidden. Users must stop trying to contact anyone who has expressed a desire not to be contacted further.

Users may not upload, publish, or transmit any content (text, image, audio, video, etc.) that:
- Is illegal, harmful, threatening, violent, abusive, defamatory, obscene, racist, hateful, or otherwise inappropriate
- Encourages suicide, criminal activity, hate speech, genocide denial, or extremist ideologies
- Impersonates Tale staff or affiliates
- Infringes upon intellectual property rights or other proprietary rights
- Is promotional, spam, or unsolicited advertising
- Interrupts or disrupts the Service, its servers, or any network connected to the Service
The User is expected to exercise discernment and fully assume the risks associated with content shared or consumed via the Service.

Account Sanctions

In the event of rule violations, Tale reserves the right to block, suspend, or delete the User’s account without notice or compensation.Users are warned not to share sensitive data (credit card info, address, phone, etc.), even if prompted by someone claiming to be Tale staff. Tale staff will never ask for such information.Users remain solely responsible for any damage they may cause to others.

Licensing and Intellectual Property

In return for using the Service, Users grant Tale a free license to use data for research, development, and machine learning purposes during the time such data is available on the platform.Tale grants the User a non-exclusive, personal, non-transferable license to use the Services and related software on compatible devices (smartphones, tablets), and prohibits any attempt to copy, reverse engineer, sublicense, or redistribute such software, unless allowed by law.All intellectual property — including text, images, sound, video — remains the exclusive property of Tale. Users may not reproduce or use them beyond normal app usage. Tale reserves the right to revoke this authorization at any time. Any unauthorized or abusive use of Tale's intellectual property may result in legal action.

Article 9 — Hyperlinks & Third-Party Sites

The pages of the Services may contain hyperlinks redirecting to websites published, hosted, or operated by third parties (hereinafter referred to as “Third-Party Sites”) over which Tale exercises no form of control.

Tale assumes no responsibility for the content of Third-Party Sites, or for any content that such Third-Party Sites may link to.

The presence of hyperlinks to Third-Party Sites shall not be interpreted as Tale endorsing, in any way, the content of such Third-Party Sites.

Tale is not responsible for any changes or updates made to Third-Party Sites.

Tale is not responsible for the transmission of information from Third-Party Sites or for any malfunction they may experience.

These links to Third-Party Sites are provided solely for the User’s convenience.

Users and/or Visitors are solely responsible for any transactions conducted with third parties, including advertisers that appear on the Service’s web pages, including delivery operations and payment for goods and services.

Article 10 — Force Majeure

Tale shall not be held liable, nor considered to have breached these terms, for any delay or failure to perform where such delay or failure results from an event of force majeure as defined by the case law of French courts and tribunals. This includes, but is not limited to, acts of government, cyberattacks, unavailability of equipment, supplies, spare parts, personal or other equipment, and any interruption, suspension, reduction, or disruption of electricity or other utilities, or of electronic communication networks.

Article 11 — No Waiver

The fact that Tale does not invoke a failure or breach by the User of any of their contractual or legal obligations shall not be interpreted as a waiver of Tale’s right to invoke such failure or breach. Similarly, Tale’s decision not to enforce a provision of these Terms of Use shall in no way constitute a waiver of the benefit of said provision.

Article 12 — General Provisions

Given the nature of their exchanges, and in particular the digital nature of their relationship, the Parties agree that all computer records stored in Tale’s information system shall constitute evidence in the event of a dispute.
These Terms of Use for Tale’s online services, together with the Privacy Policy, constitute the entire agreement between the parties with respect to their subject matter.
They supersede and replace any prior or contemporaneous agreements, communications, representations, or proposals, whether oral or written, relating to the same subject.
These Terms of Use and Privacy Policy shall prevail over any other document exchanged between Tale and the User, unless expressly agreed otherwise in writing by Tale.

Article 13 — Governing Law

These Terms and Conditions are governed by, interpreted under, and enforced in accordance with French law.

Any translation of these Terms of Use and the Privacy Policy into a language other than French is provided for informational purposes only. The French version shall prevail and be binding in case of any discrepancies or interpretive disputes.

Jurisdiction: The competent court shall be the Tribunal de Grande Instance of Toulouse.
Use and access to the Service are governed by these Terms of Use.
